    CAN A NON-FLAT AND SMOOTH SUBFLOOR OR SUBSTRATE DAMAGE MY FLOORING?

    YES! 

    INSTALLERS AND FLOOR CONTRACTORS ARE REQUIRED TO EXAMINE THE SUBSTRATE FOR FLATNESS AND SMOOTHNESS TO THE MANUFACTURERS' TOLERANCES. THE DAMAGE, HOWEVER, IS NOT CONCAVE OR CONVEX, CUPPING, BOWING OF THE PLANKS. 


    CAN MOISTURE VAPOR OR WATER CAUSE CAUSE PLANKS TO WARP OR CUP OR BOW? 

    YES, BUT ONLY RECENTLY HAVE  MANUFACTURERS ADMITTED THIS AFTER MILLIONS OF VINLY PLANKS WERE INSTALLED WITHOUT VAPOR, MOISTURE, BARRIERS OR RETARDERS TO PREVENT THIS FROM HAPPENING. IT WAS NOT A REQUIREMENT OR SUGGESTION IN THE INSTALLATION INSTRUCTIONS ORIGINALLY . 

    THE REQUIREMENTS ONLY RECENTLY HAS BEEN PUT IN INSTALLATION INSTRUCTIONS AND WARRANTIES. 


    THIS KNOWLEDGE ABOUT VINLY PLANKS AND MOISTURE HAS BEEN KNOWN FOR MANY YEARS IN RESEARCH BY WOOD SCIENTISTS AND SCIENTISTS WHO EVALUATE BUILDING MATERIALS IN HOMES AND COMMERCIAL BUILDINGS. 


    IF I BOUGHT A VINLY PLANK FLOORING IN THE LAST SEVERAL YEARS, AND IT WAS EXPOSED TO MOISTURE, IS IT MY RESPONSIBILITY OR THE CONTRACTOR OR INSTALLERS?

    NO, NOT YOUR RESPONSIBILITY, VAPOR BARRIERS WERE NOT RECOMMENDED OR REQUIRED UNTIL RECENTLY! THE MANUFACTURER CANNOT BLAME THE CONTRACTORS IF THEY DON'T HAVE COMPLETE INSTALLATION INSTRUCTIONS AND PROBLEMS ARISE LATER. 


    WERE VINYL PLANKS SOLD AS WATER AND MOISTURE PROOF? 

    YES, THEY WERE!


    CAN NEW REQUIREMENTS  IN WARRANTIES BE USED TO DENY MY CLAIM? 

    NO! NO! NO! AND AGAIN, NO!

    ONLY THE WARRANTY CONDITIONS AT THE TIME OF SALE CAN BE APPLIED TO DENY YOUR CLAIM. 

    THEY CANNOT WRITE NEW INSTRUCTIONS THEN APPLIY THEM TO FLOORING SOLD BEFORE THE NEW ONES WERE WRITTEN. 


    CAN I FILE A CALIM IN SMALL CLAIMS COURT IF MY NEW FLOOR CAUSED LESS THAN $10.000.00 OR  $15,000.00?

    YES, ANYONE CAN FILE A CLAIM IN SMALL CLAIMS COURT, CALLED MAGISTRATE COURT, IF THE COST IS LESS, USUALLY $15,000, AND THE COST TO FILE CAN BE AS LOW AS $50 - $100 IN MOST STATES.
